The division of joint finances is undoubtedly one of the least pleasant aspects of divorce. How will the court divide property? What are the effects on your taxes? North Dakota Property Division/Community Property/Debts:

North Dakota is an “equitable distribution” state. This means that the court will divide marital property on terms considered to be fair, but this does not necessarily mean that the division will be equal. In making this determination, the court will consider, among other things, the contributions of each spouse to the marital estate, the total value of the properties of the parties, the economic circumstances of each party, any misconduct that may have occurred, and the amount of spousal support awarded, if any.  

North Dakota Spousal Support:

The court grants spousal support (also called maintenance or alimony) on a case-by-case basis and in consideration of the relative economic circumstances of the parties. Alimony orders may terminate at any time upon court order.
