South Dakota marriage laws require couples to obtain a valid marriage license before tying the knot. Minors must get parental consent, and those under 16 cannot get married in South Dakota. South Dakota Marriage Consent Laws

  • With Parental Consent: 16 and 17 year-olds must obtain written and notarized parental consent before being married in South Dakota. Minors younger than 16 will not be issued a marriage license.

  • Without Parental Consent: Adults 18 and older may marry in South Dakota without parental consent.

 

South Dakota Common Law Marriage

South Dakota does not recognize common law marriages.

 

South Dakota Marriage License

  • Residency: No residency requirement.

  • Tests: None.

  • Identification Required: Driver’s license or a certified copy of birth certificate are required.

  • Appearance/Proxy: Proxy marriages are not allowed in South Dakota.

  • Previous Marriages: Divorced individuals should bring a certified copy of their divorce decree. Certified copy of the death certificate is not required for widows, but a regular copy is suggested.

  • Length of License: 20 days from the time of issuance.

  • Fees: $40, generally payable only in cash.
