Rhode Island Marriage
Rhode Island marriage laws require couples to obtain a valid marriage license, issued by the state, before they can get married. For minors, this will require getting parental consent and, in some cases, Rhode Island family court approval as well. Rhode Island continues to recognize common law marriages. The requirements for obtaining a Rhode Island marriage license are detailed below.
Rhode Island Marriage Consent Laws
- With Parental Consent: Males under 18 must obtain parental consent and the approval of a family court judge in order to get married in Rhode Island. 16 and 17 year-old females can marry only with parental consent, and females under 16 must also get the approval of a family court judge.
- Without Parental Consent: Adults 18 and older can marry in Rhode Island without parental consent.
Rhode Island Common Law Marriage
Rhode Island is one of the few states that continue to recognize common law marriages. The creation of a common law marriage in Rhode Island requires two fairly simple elements: (1) the couple seriously intended to enter into a husband and wife relationship and (2) their conduct was such that the community believed they were married.
Rhode Island Marriage License
- Residency: No residency requirement.
- Tests: None.
- Identification Required: Certified copy of birth certificates and a social security number must be provided.
- Appearance/Proxy: Proxy marriages are not available in Rhode Island. Both parties must be present at the time of applying.
- Previous Marriages: Previously married individuals must present a certified copy of the divorce decree or death certificate to prove the marriage ended.
- Length of License: 90 days from the time of issuance.
- Fees: Generally, $24, payable in cash only.
- Authorized Rhode Island Officiants: Judges and ordained ministers.
