My ex who has custody of our 7-year old son lives with someone without being married. Can custody be changed in this situation? What if it was a homosexual living arrangement? |

Because it is still illegal to cohabit without being married in Virginia this could cause the court to reconsider its position. It doesn't want to be put in a position of sanctioning an illegal act, no matter how prevalent. If both parties were cohabiting without being married, it would be a wash.
In Virginia you can remove a child from a home where the cohabiting parties are involved in a homosexual relationship. You should check with an attorney in your area to determine how your local court may look upon this. |
