My ex who has custody of our 7-year old son lives with someone without being married. Can custody be changed in this situation? What if it was a homosexual living arrangement?
Because it is still illegal to cohabit without being married in Virginia this could cause the court to reconsider its position. It doesn't want to be put in a position of sanctioning an illegal act, no matter how prevalent. If both parties were cohabiting without being married, it would be a wash.

In Virginia you can remove a child from a home where the cohabiting parties are involved in a homosexual relationship. You should check with an attorney in your area to determine how your local court may look upon this.
