What happens in a custody dispute where one parent is mentally ill? |
 |
| If there is a history of mental or emotional illness, it will likely be presented as evidence in court and the judge will request a psychiatric evaluation. The issue is what effect the illness has on the parent-child relationship. Does the illness affect the parent’s ability to care for a child, and/or put the child in danger? |
